Rome LLP has filed a federal class action lawsuit against NAB-CW LLC (operating as CWA Merchant Services) and Merrick Bank Corporation.
The case, brought on behalf of Cordiota Inc. and a proposed nationwide class of similarly situated merchants, seeks to hold these entities accountable for assessing unauthorized and undisclosed Early Termination Fees (ETFs) in violation of both contractual terms and applicable card brand rules.
The complaint asserts that CWA Merchant Services and Merrick Bank systematically imposed ETFs on merchants without proper disclosure, including failing to include such fees in the mandatory “Fee Disclosure” section of their respective merchant processing agreements. In several cases the defendants withheld funds from merchants—sometimes in their entirety—without proper authority or prior notice.
The suit seeks both compensatory and punitive damages, as well as injunctive relief to bar ongoing enforcement of undisclosed fees.
